Terms of service
The standard terms that apply to all contracts and work undertaken by Geeks Crew.
These terms apply to all website design and development, software, hosting and digital marketing work undertaken by Geeks Crew ("we", "us"). By instructing us to proceed with a proposal, you ("the client") agree to these terms.
Non-disclosure
We, and any subcontractors we engage, will not disclose your confidential information to any third party. We are happy to sign a separate NDA on request.
Fees and deposits
A 50% deposit of the total fee in our proposal is due when you instruct us to proceed. The remaining 50% becomes due when the work is completed to your reasonable satisfaction. We may choose not to begin work until the deposit is paid in full.
Because we book domains and hosting on the client's behalf once a project begins, the advance becomes non-refundable after those are booked — see our Refund Policy.
Revisions and variations
You may request revisions to the design. We may limit design proposals to a reasonable number and charge for additional designs if the original specification changes. Development allows minor variations; major deviations from the agreed specification will be quoted separately.
Hosting and fair usage
Shared hosting packages are designed for business websites and standard email use, not for large-scale email services or applications better suited to cloud or dedicated servers. If a project requires more resources than the agreed plan, we will inform you and may move it to a suitable plan (including a one-month trial of business or dedicated hosting where needed). If you prefer to host elsewhere, we will share a complete backup of the project. Deployment to a self-managed or third-party server may be charged for additional time.
Hosting fees are not refundable once a site is live.
Timelines and client cooperation
Timelines depend on your full cooperation, including timely feedback and final content (text, images, logos). Please appoint a single point of contact who is available to give feedback so each phase can progress.
Approval of work
On completion we will notify you to review the work. Please tell us in writing about anything unsatisfactory within 3 working days. Work not reported as unsatisfactory within that period is deemed approved, and the balance payment becomes due.
Rejected work
If you reject work within the review period, or don't approve work we carry out to fix reported points, and we reasonably consider the rejection unreasonable, we may end the contract and recover payment for work completed.
Licensing and ownership
Once you have paid in full, you own the website or software we created for you and receive the source code. Third-party components (themes, plugins, fonts, stock images) remain subject to their own licences.
Cross-browser compatibility
We build with current, well-supported technologies so your site works in the latest versions of Chrome, Safari, Firefox and Edge. Third-party extensions may not support every browser equally; where issues arise we will use alternatives or workarounds on a best-effort basis.
Supply of materials
You agree to supply all materials needed to complete the work (copy, photographs, logos and so on). Delays in supplying materials may extend agreed deadlines. You must hold the rights to all content you supply, and we may remove content that infringes copyright under the Copyright Act, 1957 (as amended).
You agree to indemnify us against claims arising from content you supply.
Search engines
We do not guarantee any specific position in search results. We follow current SEO best practice and report transparently on progress.
Additional expenses
You agree to reimburse expenses not included in the proposal that you request, such as premium themes, third-party software, stock photography, fonts, domain registration or hosting.
Backups
You are responsible for maintaining your own backups unless backups are included in a maintenance plan with us. We are not liable for restoring data except where loss results from our negligence.
E-commerce compliance
You are responsible for complying with laws that apply to your online business, including taxation and consumer protection rules.
Domains and transfers
Domains we register for you are registered in your name or on your behalf. If you choose to move your domain or hosting to another provider, we will assist promptly once all outstanding dues are cleared.
Limitation of liability
To the extent permitted by law, our liability is limited to re-supplying the services or refunding the fees paid for the specific services concerned. We are not liable for indirect or consequential loss, including loss arising from delays however caused.
Subcontracting
We may subcontract parts of the work where appropriate, and remain responsible for its quality.
Governing law
These terms are governed by the laws of India. Disputes are subject to the jurisdiction of the courts at Chandigarh.
Changes to these terms
We may revise these terms from time to time. If you believe a change affects an ongoing project, let us know within 10 days of the update.
